VETS-100 Reporting Deadline Extended to October 31, 2009


The VETS-100 and VETS-100A reports are typically due each year by September 30th. This year, due to a high volume of calls, the Department of Labor (DOL) VETS-100 help desk and email system are overloaded. As a result, their website indicates that federal contractors "who are not able to reach the help desk" are able to file the report as late as October 31, 2009. The DOL does not make it clear how an employer is to prove that they have attempted without success to reach the help desk. However, its voicemail recording says that this extension is available to "all federal contractors."

The VETS-100 reporting requirements generally apply to contractors with a current government contract or subcontract that was modified on or after December 1, 2003 in the amount of $25,000 or more; or a contract that was modified on or after December 1, 2003 in the amount of $100,000 or more as modified. A contractor must submit the VETS-100A Report, rather than the VETS-100 Report, if such a contract or subcontract was modified on or after December 1, 2003 in the amount of $100,000 or more as modified. A contractor must submit both the VETS-100 and the VETS-100A Reports if it has a current government contract or subcontract in the amount of $25,000 or more that was entered into before December 1, 2003 (and not modified on or after that date) and a current government contract or subcontract in the amount of $100,000 or more that was entered into or modified on or after December 1, 2003.

The VETS-100 Report relates the number of employees and new hires during the reporting period who are special disabled veterans; Veterans of the Vietnam era; other protected veterans (veterans who served on active duty in the U.S. military during a war or in a campaign or expedition for which a campaign badge is awarded); and recently separated veterans (veterans within 12 months from discharge or release from active duty).

The VETS-100A Report relates the number of employees and new hires during the reporting period who are disabled veterans; other protected veterans (veterans who served on active duty in the U.S. military during a war or in a campaign or expedition for which a campaign badge is awarded); Armed Forces service medal veterans (veterans who, while serving on active duty in the Armed Forces, participated in a United States military operation for which an Armed Forces service medal was awarded pursuant to Executive Order 12985); and recently separated veterans (veterans within 36 months from discharge or release from active duty).

The other significant difference between the VETS-100 and VETS-100A Report forms is in the job categories.

  • Determine if you are required to file
  • If required, file no later than October 31
